Understanding Special Assessments in Florida Condos

If you own a condo or are considering buying one in Boca Bayou, special assessments are something you should understand before making financial decisions. If you ever see a notice about a special assessment, it’s important to look closely at the details. These fees are separate from regular condominium association fees. Furthermore, they can affect both current owners and prospective buyers. As a longtime Boca Bayou resident and condo specialist, I believe the best approach is to understand why an assessment exists and what it covers. In addition, you should know what the association records actually show.

 

What Is a Special Assessment?

Florida law defines a special assessment as an assessment charged to a unit owner outside the association’s annually adopted budget. DBPR makes the same distinction between regular assessments, which fund expenses in the annual budget. Additionally, special assessments cover expenses outside that budget.

That does not automatically mean something is wrong with a condominium community. Buyers should consider an assessment in context by understanding its purpose, amount, payment schedule, and the project or expense it will fund.

Reserve Studies Can Affect Future Costs

Florida’s Structural Integrity Reserve Study requirements are intended to help qualifying condominium associations plan for major repairs and replacement of structural components. DBPR describes a SIRS as a budget-planning tool. Specifically, it reviews association-maintained building components, existing reserves, and anticipated funding needs.

Current financing guidance also makes reserve funding increasingly important. NAR reported in March 2026 that larger condominium projects face greater reserve and documentation expectations. As a result, this can contribute to higher association fees or special assessments in some circumstances.

For buyers, the important question is not simply whether an assessment exists. It is what the assessment is paying for and what the association’s broader financial picture looks like.

Condo Owners Have Notice Rights

Florida condominium owners must receive at least 14 days’ notice of a meeting where the association will consider a special assessment. The notice must state that assessments will be discussed and include the estimated cost and purpose. In addition, the association’s governing documents determine whether the board or unit owners approve special assessments.

If you own a condo, reading meeting notices rather than simply filing them away can help you stay informed about upcoming financial decisions.

Buyers Should Review More Than the Monthly Fee

NAR recommends that condo buyers review association finances and reserves and ask specifically about past or planned special assessments.

Florida has also expanded access to association information. For condominium associations subject to the website requirement, current law requires approved board meeting minutes from the preceding 12 months and other specified documents to be available online. Florida Realtors noted that this increased transparency can help prospective purchasers identify assessments being discussed before they are formally adopted.

That is why I encourage Boca Bayou buyers to look beyond the advertised monthly association fee. Budgets, reserves, meeting minutes, inspection reports, and association documents all help provide a fuller picture.

Sellers Should Confirm Assessment Information Early

For sellers, knowing the status of special assessments before listing helps avoid surprises later. Florida Realtors explains that an association estoppel certificate provides information about assessments and other amounts owed or scheduled to become due for a specific condo unit.

As a Boca Bayou seller, you do not want to guess about an assessment or rely on outdated information. Therefore, confirm the current details through the association and transaction documents so buyers receive accurate information.

Special assessments are part of condominium ownership, but they should be evaluated with facts rather than assumptions. Whether you are buying or selling in Boca Bayou, understanding the reason for an assessment is important.
