Also, the law prohibits a unit owner from doing anything that adversely affects the safety or soundness of the common elements or association property.

If the declaration doesn’t set its own process, 75% of the total voting interests must approve material alterations or substantial additions (per §718.113).

Florida now requires milestone inspections for condo/co-op buildings 3 stories or taller—at 30 years from the certificate of occupancy (or 25 years if within 3 miles of the coastline), and every 10 years thereafter—so projects that could affect structure face higher scrutiny.

  • Limited common elements (e.g. balconies, terraces, patios) often require board approval even though they are tied to your unit.
  • Major system changes: Altering plumbing or HVAC risers, electrical line extensions through common spaces, altering load distribution—all require board, engineering review, and often permits.
  • Exterior changes: Windows, doors, building envelope, exterior walls—not typically within your control.

If your condo documents are silent on these changes, the default legal threshold of 75% approval applies. Always confirm with your board before beginning any large-scale condo upgrades.

Permits, Contractors & Compliance

Even when your association approves your project, local building permits are often still required. Most structural, plumbing, and electrical work needs city or county approval to stay compliant.
